1. PRIVACY POLICY
Dalten Media respects the privacy of their Dalten Media users. We do not disclose or sell user account information to third parties. Your email will be used only to notify you about Dalten Media -related news.
Dalten Media will not monitor, edit, or disclose the contents of a user’s website unless obliged to do so by law or if such action is necessary to: (i) protect and defend the rights or property of Dalten Media or (ii) fix or debug problems with the Dalten Media software/service.

2. DISCLAIMER OF WARRANTIES
As User of the service you agree that the use of the service is at Users sole risk. The service is provided on an “as is” and “as available” basis. Dalten Media disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Dalten Media makes no warranty that the service will meet your requirements, or that the service will be uninterrupted, timely, secure, or error-free. Nor does it make any warranty as to the accuracy or reliability of any information obtained through this service or that defects in the software will be corrected. You understand that any material/data downloaded or otherwise obtained through this service is done at your own risk and that you will be soley responsible for any damage to your computer system or loss of data that results in such a download.

No advice or information, either oral or written, obtained by you from DaltenMedia .com.au shall create any warranty not expressly stated herein.

3. LIMITATION OF LIABILITY, INDEMNIFICATION
Dalten Media shall not be liable for:
(i) Any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the service
(ii) Cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messgaes received or transactions entered into through this service
(iii) Unauthorised access to or alteration of Member’s transmissions or data, including but not limited to damages or loss of profits
(iv) Statements or conduct of any third party on the service

4. LAWS
The Dalten Media Terms of Use shall be governed by and construed in accordance with the laws of the Australia.

Terms of Use

1. ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF USE
Your use of Dalten Media indicates your agreement to the Dalten Media Terms of Use laid out below and acknowledgment of the Dalten Media Legal Statements.  These documents may be modified without prior notice provided that the terms regarding the introduction of paid services are not altered without timely notification of all users.  User’s continued use of the service constitutes an affirmative acknowledgment by user of these modifications.

The most current version of The Terms of Use and Legal Statements will always reside online at http://DaltenMedia.com.au .  The Dalten Media Terms of Use and Dalten Media Legal Statements comprise the entire agreement between the Dalten Media users and Dalten Media  unless otherwise indicated.

2. DESCRIPTION OF SERVICE. MODIFICATIONS TO SERVICE
Dalten Media provides users with various web publishing and content management services, including but not limited to the ability to create and maintain a web page as well as the hosting services for this webpage.  In order to use the service users should provide for own access to internet and pay any service fees associated with such access.

Dalten Media reserves the right to change the terms of service and prices for paid upgrades without prior notification.

3. USERS OBLIGATIONS AND CONDUCT
Each user bears the sole responsibility for the content published on their Dalten Media website.  Dalten Media  does not control the content posted via the service and, as such, does not guarantee the accuracy or quality of such content and cannot be held responsible for it. Use of the service is subject to all applicable local, state, national and international laws and regulations as well as to internet-specific policies and procedures.

User agrees:
(i) not to use the service for illegal purposes;
(ii) not to publish any material that is unlawful, harassing, abusive, threatening, offensive, vulgar, obscene, harmful, libelous, invasive of another’s privacy or constitutes an infringement of third party intellectual property rights.
(iii) not to interfere with or disrupt in any way the service including servers and networks connected to the service;
(iv) not to interfere with another user’s enjoyment of the service.
User should indemnify and hold Dalten Media  and their subsidiaries, affiliates, officers and employees, harmless from any claim or demand made by any third party due to or arising out of user’s conduct, violation of these Terms of Use by user, or the infringement by user of any intellectual property or other right of any person or entity.
Dalten Media may, at their sole discretion, terminate the service should a user’s conduct fail to conform to these terms and conditions.

4. USER ACCOUNTS AND SECURITY
Users are entirely responsible if they do not maintain the confidentiality of their password and account, as well as of password protected areas of their sites. Users are entirely responsible for any and all activities which occur under their account.
Users agree to immediately notify Dalten Media  of any unauthorized use of their account or any other breach of security known to user.

5. CONTENT OWNERSHIP
Users retain copyright ownership and all related rights for materials published on their Dalten Media website.

6. STORAGE AND OTHER LIMITATIONS
Dalten Media  reserves the right to automatically clean assets exceeding the storage limit, after sending an email notification for exceeding the limit and failure on the part of the user to take subsequent action to clean the surplus assets or alternatively request an upgrade of the account.  Dalten Media  assumes no responsibility for the deletion or failure to store information entered into Dalten Media .

7. NOTICE AND TERMINATION OF SERVICE
Either Dalten Media or the user may terminate use of the Service with or without cause at any time and effective immediately. Dalten Media  shall not be liable to users or any third party for termination of the service.  Upon termination, user’s right to use the service and the related software ceases immediately.

All notices shall be in writing and shall be made either by publication or via email.  Dalten Media  may publish notices on this website (http://Dalten Media.com.au) to inform users of changes to the service, Terms of Use, or other important procedures; such postings shall constitute notice to users.
